The statement, signed by the director of International Justice at the NGO, Balkees Jarrah, comes as ICC judges consider a request by prosecutor Karim Khan to issue an arrest warrant for Israeli Prime Minister Benjamin Netanyahu, his Defense Minister Yoav Gallant and the three top leaders of the Palestinian Islamist group Hamas.
HRW said that Khan’s request for the warrants came amid “pressure from US lawmakers and others,” but that it “reaffirms the crucial role of the court.”
The organization stressed that victims of serious abuses in Israel and Palestine “have faced a wall of impunity for decades,” and the prosecutor’s request opens the door for “those responsible for atrocities committed in recent months to be held accountable in a fair trial.”
Karim Khan today requested the issuance of arrest warrants against the Israeli prime minister and the leader of Hamas in the Gaza Strip, Yahya Sinwar.
Netanyahu and Sinwar are suspected of war crimes and crimes against humanity, according to a statement released by Khan in The Hague, Netherlands, where the ICC is based.
The prosecutor also asked the ICC to issue arrest warrants for Israeli Defense Minister Yoav Gallant, the commander of Hamas’s Al-Qassam Brigades, Mohammed Al-Masri, and the head of the Palestinian group’s political bureau, Ismail Haniyeh, who is based in Qatar.
The warrant requests come more than seven months after a new war in the Gaza Strip was sparked by a Hamas terror attack on Israeli soil that left more than 1,100 dead and some 250 people taken hostage.
In retaliation, Israel has since waged a large-scale offensive in the Palestinian territory that has killed more than 35,000 people, most of them civilians, according to the Hamas government, and caused a severe humanitarian crisis.
