Supreme Court annuls FC Porto compensation in Benfica emails case

The Supreme Court of Justice (STJ) annulled the compensation of one million euros that FC Porto had to pay to Benfica in the civil proceedings of the disclosure of Benfica emails, decreeing a new quantification of the amount.

According to the statement released today, the STJ considered that the 'dragons' must compensate Benfica and the 'incarnate' SAD "for the damages they caused them, as a consequence of the appropriation and disclosure of a vast set of emails from Benfica's email, containing reserved and confidential information related to its activity", but with a new amount to be decided later.
"As for the compensation, in the amount of 1,000,000 euros, to be paid to the club and Benfica's SAD due to reputational damages, the Supreme Court changed the decision of the Court of Appeal, relegating the concretization of the monetary amount to subsequent liquidation, given the insufficiency of the available elements", we read in the note on the ruling, which maintains the decision to convict FC Porto, Porto's SAD, Porto Canal and the communications director Francisco J. Marques. The STJ ruling also reiterated the acquittal of the former president of FC Porto, Jorge Nuno Pinto da Costa, and the former directors Adelino Caldeira and Fernando Gomes, rejecting the 'incarnate' appeal that sought their convictions. The STJ also emphasized the illicitness of the 'dragons'' actions in the ruling issued this Thursday, signed by the judges Isabel Salgado, Maria da Graça Trigo and Catarina Serra. "The defendants were ordered to compensate the plaintiffs for the illicit actions they carried out, with disrespect for the right to confidentiality of correspondence, exposing the plaintiffs' business secrets, with the purpose of obtaining an advantage in the competing activity, causing them damages of various categories", the statement says. The civil case of the disclosure of Benfica's emails on the television program Universo Porto da Bancada, on Porto Canal, between April 2017 and February 2018, saw its first decision in June 2019, when FC Porto and its communications director were ordered to pay about two million euros to Benfica's SAD, which claimed 17.7 million euros in compensation for damages to its image, credibility and commercial interests. FC Porto, on the other hand, defended that it had limited itself to disclosing information of public interest, alleging that the disclosed email revealed practices that distorted the sporting truth. The decision would be reviewed by the Porto Court of Appeal in 2022, which reduced the compensation to be paid to Benfica and which will now have to be recalculated, according to the STJ's position.
