The defendant, 51, was convicted of a crime of aggravated homicide.

According to the accusation, given as proven, the defendant was imprisoned for six and a half years for a crime of rape and a crime of damage.

He was released on parole on March 7, 2021, and went to live in his mother's house.

On the day of the homicide, and after having been drinking in cafes, the defendant had another argument with his mother and assaulted her, causing her several abrasions, bruises, lacerations and fractures.

During these assaults, "and to prevent his mother from screaming or calling for help, as she had done in previous episodes", the defendant covered her nose and mouth, "until he managed to take her life".

He then called a sister who had emigrated to France saying that he had killed his mother, and also went to a local cafe to report the homicide.

"The defendant acted with the specific purpose of taking his mother's life, covering her mouth and nose for several minutes to the point where she could not breathe, since he knew that by acting in this way she would end up dying from asphyxia", states the accusation.

In court, and in a very confused speech, the defendant denied committing the crime, claiming that he found his mother dead next to the bed, but the panel of judges did not accept his version.

The defendant underwent two expert assessments of his mental faculties, and in both cases he was considered imputable.

The defense also requested a third expert assessment, which was rejected by the court.

The court also declared the defendant's unworthiness to inherit, thus preventing him from inheriting assets left by his mother.

The defense has not yet decided whether or not to appeal the court's decision.
