Doctor asks patient about lipoma location and operates on wrong side
The patient still has the lipoma to be operated on, but now has "pain in both sides".

A patient at Hospital da Luz – Oeiras who was scheduled for minor surgery to remove a lipoma from the right side of her “upper buttock region” was instead operated on the left side, after being asked about the location of the lesion and pointing to the wrong place, due to her “anxious state”. As it turns out, the patient still has the lipoma, but now has “pain on both sides”.
“I came in for minor surgery to remove a lipoma on the right side of my upper buttock region. When I went into the treatment room, the doctor asked me to point out the place that was supposed to be operated on. I was anxious and pointed to the wrong place. The doctor clearly didn't read my exam before opening up the wrong side. He removed something from the left side […], I still have the lipoma on the right side and now I have pain on both sides […]”, the patient said, in a complaint revealed by the Health Regulatory Authority (ERS).
The surgery took place on 30 May 2023, and according to the ERS's investigation, the “’[e]xcised lesion does not correspond to the laterality of the lesion identified by ultrasound’, and the patient signed an informed consent that did not identify the laterality of the intervention”.
“And, although in the case at hand, the ‘results of the pathological anatomy [have] confirmed that the lesion excised on the left corresponds to adipose tissue compatible with lipoma/lipomatosis’, it cannot be forgotten that the error that occurred carries, even in the abstract, the potential to produce a serious impact on the quality and safety of the healthcare provided”, the entity stated.
Along these lines, the ERS issued an instruction to the hospital unit, so that it could guarantee “on a permanent basis, that in the provision of healthcare, the rights and legitimate interests of patients are respected, namely, the right to appropriate care, technically more correct, with humanity and promptness”, in addition to “ensuring, at all times, the quality and safety of the healthcare provided, guaranteeing the inclusion/identification of the laterality of the procedures proposed in the informed consent form signed by the patient(s)”.
