A woman from Caldas da Rainha demands that her ex-husband pay her 600,000 euros in compensation for "damages caused by the frustration of the marriage" which, she says, "should have lasted a lifetime", but ended "abruptly and inexplicably" due to the man's "exclusive will".
The marriage, celebrated in 2014, ended in divorce in court in February of this year.
Correio da Manhã reports, citing a ruling also consulted by Notícias ao Minuto, that the woman, unhappy with the divorce, filed a lawsuit in court demanding that her ex-husband pay "30,000 euros for each year of loneliness , suffering, bitterness, discouragement and all the nightmares that will befall a repudiated wife, compensation totalling 600,000 euros".
The said action was filed in the Family and Minors Court of Caldas da Rainha, which absolved the man of any payment. However, he did so not because he disagreed with the request, but because of "absolute incompetence in terms of the matter". In other words, the action should have been filed in a court of civil jurisdiction.
Thus, the woman appealed to the Coimbra Court of Appeal, where the judges confirmed the appealed decision and added that "the injured spouse has the right to request compensation for damages caused by the other spouse", but "in the general terms of civil liability and in the ordinary courts", which "in no way contradicts the rules or constitutional principles".
The costs of the process are a burden on the woman, who, however, is exempt from any payment, as she benefits from legal aid.
