The single sentence resulted from the legal accumulation applied to the defendant, a Portuguese-American citizen, for two crimes of qualified theft, one of which was attempted.

The defendant, who is serving a prison sentence for identical crimes, was also accused of another attempted theft crime, related to an assault on a pastry shop, but was acquitted due to lack of evidence.

Although the law allows for the suspension of sentences of less than five years in prison, the court decided not to do so, taking into account the defendant's criminal record, who has several convictions for theft crimes, for acts committed since 2013.

The judge also highlighted that the defendant has already served long sentences for the practice of identical crimes, indicating that "the previous convictions were not enough to deter him from practicing this type of crime".

The crimes occurred in June 2020, less than a month after the defendant was released from prison.

In the case of the assault on the bank branch, the judge pointed out that, although the defendant had remained silent, the video surveillance images together with the time the alarm was triggered led to the conclusion that "the facts occurred as stated in the indictment".

The court also found it proven that the defendant assaulted a transport company, in the Bunheiro Industrial Zone, from where he took at least 120 euros and a computer.

During the trial, the defendant partly confessed to the facts related to the assault on the transport company.

Another defendant who was accused of a crime of receiving stolen goods was also acquitted due to lack of evidence.
